2. Description of Services

Euser AI Solutions provides business automation consulting, including but not limited to:

• AI Agent Development: Building chatbots for customer support or sales.
• Workflow Automation: Connecting apps (e.g., WhatsApp, CRM, Email) using tools like n8n.
• Hosting: Hosting custom automation scripts and databases.

3. Artificial Intelligence Disclaimer (Crucial)

You acknowledge that our services utilize Artificial Intelligence (AI) and Large Language Models (LLMs) provided by third parties (e.g., OpenAI, Anthropic). By using our services, you agree to the following:

3.1. Accuracy & Hallucinations

AI models may occasionally produce incorrect, misleading, or offensive information ("Hallucinations"). Euser AI Solutions makes no warranties regarding the accuracy, reliability, or completeness of any content generated by our AI agents.

Your Responsibility: You agree to review and verify all AI-generated outputs before using them for critical business decisions, legal contracts, or medical advice.

3.2. Service Availability

Our services rely on third-party APIs (e.g., OpenAI API, WhatsApp Business API). We are not liable for service interruptions, downtime, or data loss caused by outages from these third-party providers.

4. User Responsibilities

You agree NOT to use our services to:

• Generate content that is unlawful, harmful, threatening, or defamatory under Kenyan Law.
• Attempt to reverse engineer, decompile, or discover the source code of our n8n workflows or proprietary agents.
• Input sensitive personal data (such as Personal Health Information or Credit Card numbers) into the AI agents unless explicitly authorized in a separate Data Processing Agreement.

5. Intellectual Property Rights

5.1. Our IP

All "Standard Operating Procedures" (SOPs), pre-built n8n templates, and proprietary code developed by Euser AI Solutions remain our exclusive property. You are granted a non-exclusive license to use these tools for your internal business purposes only.

5.2. Your Data

You retain full ownership of the data (e.g., customer leads, property listings) you input into our system. You grant us a limited license to access and process this data solely to perform the requested automation services.

6. Payment and Refunds

6.1. Fees

Services are billed according to the specific proposal or subscription plan agreed upon (e.g., "Monthly Retainer" or "One-Time Setup").

Accepted Methods: We accept payments via M-PESA, Bank Transfer, and Credit Card.

6.2. Refund Policy

• Setup Fees: Due to the extensive labor involved in configuring custom automation, Setup Fees are non-refundable once work has commenced.
• Retainers: Monthly subscription cancellations require 30 days' written notice via email.

7. Limitation of Liability

To the maximum extent permitted by the laws of Kenya, Euser AI Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any errors or hallucinations produced by the AI agents.
• Unauthorized access, use, or alteration of your transmissions or content.

8. Indemnification

You agree to defend, indemnify, and hold harmless Euser AI Solutions and its employees from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your violation of these Terms or your misuse of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising from these Terms shall be resolved in the courts located in Nairobi, Kenya.
